Insurance and Car Accidents
It is illegal to drive without car insurance in Tennessee as well as most other states. At a minimum, bodily injury and property damage liability are required by law for all motorists. The tort system in Tennessee requires the application of a modified comparative negligence rule for the determination of fault for an auto accident. In some auto accidents, it may be determined that one or more of the drivers involved were careless in causing the accident. In these cases comparative negligence may be enforced. Tennessee’s modified comparative negligence rule states that:
- If a driver was equally as negligent or more than the other party, no damages can be recovered
- If the driver is found to be less than 49% at fault, the driver may receive reduced compensation
While this may seem like a straightforward system, filing auto insurance claims and receiving the proper compensation can be a tricky endeavor. At James R. Omer & Associates, PLLC, our experienced auto accident attorneys have helped hundreds of auto accident victims navigate the legal and insurance systems in order to receive payment for such hardships as:
- Lost wages
- Injury treatment and medical bills
- Auto repairs and rental car reimbursement
- Pain and suffering
Insurance companies are trained to settle auto insurance claims as quickly as possible, often offering victims as little compensation as possible without appearing tightfisted. Without a trained team of professionals in your corner, you may inadvertently accept a settlement offer that is well below what you are legally due.
If you live in the Nashville, Tennessee area and have been a victim of a car accident, please contact the car accident attorney team at James R. Omer & Associates, PLLC to arrange a consultation.

Common Types of Workers’ Compensation
Workers' compensation exists to help defray medical and other expenses when people are injured on the job. Typically, worker's compensation picks up where the individual's insurance leaves off, paying for expenses that aren't otherwise covered.
If you're injured on the job, you may be entitled to one or more types of compensation. Common types of workers’ compensation include:
- Medical payments – compensation for medical bills incurred due to your injuries
- Disability payments – reimbursement of two-thirds of your average salary for the amount of time you're unable to work, whether it's short-term, long-term, or permanent
- Death benefits – benefits paid to the surviving family if an employee is killed on the job
Claiming worker's compensation benefits can sometimes be difficult, particularly if a large company is reluctant to make the reparations due to you. Retaining the services of an experienced worker's compensation attorney can help you handle the complicated issues involved in dealing with a corporation.
Nashville, Tennessee workers' compensation lawyers at James R. Omer & Associates have extensive experiences securing compensation for their clients. If you've been injured on the job and need an attorney to help you secure the benefits you need to keep yourself and your family financially afloat, please contact James R. Omer & Associates for an evaluation of your case.

Criminal Law
Being accused of a crime can be a frightening experience. Being convicted is even worse. If you're convicted of a crime, that conviction will never go away. If the crime in question was a felony, many rights you once took for granted will be taken away from you permanently. You may lose your driver's license, professional licenses, scholarships, your right to vote, or your right to carry a firearm. However, individuals charged with a crime are innocent until proven guilty. In order to be convicted of a crime, the case against them must be proven beyond any reasonable doubt. It's the job of a criminal defense lawyer to find those areas of doubt that can help keep an innocent person out of jail, prevent an overly harsh sentence, or even get a case dismissed if insufficient evidence is presented or the prosecution fails to follow proper procedure.
James R. Omer & Associates, PLLC, was founded by a criminal lawyer, so our practice has extensive experience in this area. We believe everyone should have a fair trial, and do everything we can to secure this for our clients. If you need an experienced attorney to represent you in a criminal case, please contact Nashville, Tennessee criminal attorneys at James R. Omer & Associates.

Nashville Truck Laws
Although collisions with commercial trucks involve motor vehicles, they’re not handled in court the same way as automobile accidents are. Commercial trucks and truckers are regulated by national and state laws that differ from those that regulate regular vehicular traffic. If you’re involved in an accident with a commercial truck, you’ll deal with the company that employs the driver and owns the truck, rather than with the individual himself.
While commercial trucking accidents can be simply unavoidable accidents just like any other vehicular collision, sometimes they’re due to negligence on the part of the driver or the trucking company.
Litigation with a large company can be much more difficult than dealing with an individual. Representatives of a trucking company sometimes even approach victims of this kind of accident to offer out-of-court settlements. This kind of settlement will likely be insufficient for your needs. You’ll be much more likely to receive an equitable settlement if you consult with an experienced trucking accident attorney.
The qualified and experienced attorneys at James R. Omer & Associates, PLLC, can help you establish your case against even the biggest trucking companies. Please contact Nashville, Tennessee trucking accident lawyers James R. Omer & Associates to find out how we can help you.

Nashville Dog Bite Laws
The laws regarding dog bite injuries in Tennessee are somewhat complicated. In general, if the owner has not established appropriate control over their dog, and the dog injures you, the owner could be found liable for those injuries.
Liability for dog bite injuries largely rests on proving negligence on the part of the owner. If the injuries occurred when the dog was somewhere it shouldn't have been due to owner neglect, or if the dog was known to be aggressive before the bites occurred, negligence could be proven against the owner.
If a dog is known to have aggressive tendencies toward people, the owner is expected to maintain the animal in a manner that will keep it from endangering other people. If a dog is allowed to run loose and causes injury to someone else as a result, the owner should be held liable for those injuries.
Because of the complexity of proving liability, it's best to consult a dog bite injury attorney for advice about how to handle your particular situation. James R. Omer & Associates, PLLC, have a great deal of experience with cases involving dog bites and can help you determine if you have a case. Please contact the Nashville, Tennessee dog bite injury attorneys at James R. Omer & Associates to find out what we can do to help you.

Boating Accidents
While boating accidents are much less common than other vehicular accidents, they still result in up to 1,000 fatalities a year in the U.S. Most of these fatalities are due to drowning. Injuries sustained during boating accidents number in excess of 4,000 per year.
As with many vehicular accidents, boating accidents can be largely prevented through caution and common sense. Operating a boat while impaired by alcohol or drugs is just as dangerous as operating a car or motorcycle under similar conditions. Using safety equipment can also greatly reduce your risk of death or injury. Many boaters don't wear appropriate flotation devices while out on the water, increasing their risk of drowning if they should fall out of the boat or be ejected from it. In fact, the majority of boating-related deaths occur by drowning, and almost all of those could have been prevented by use of flotation gear.
To avoid injury or death while boating, it's important to:
- Obey rules and regulations
- Stay in areas designated for boating
- Wear appropriate safety and flotation gear
If you have been injured in a boating accident and are in need of legal assistance, please contact Nashville, Tennessee boating accident attorneys James R. Omer & Associates. We'll do everything we can for you to get you the compensation you need and deserve.

Slip and Fall Accidents
Slip and fall accidents can lead to minor injuries such as bruises or sprains, but they can also cause serious injuries like broken bones. Some slip and fall injuries are severe enough to cause head trauma, brain injury, or even death.
If you slip and fall while on someone else’s property, or in a public area, those responsible for maintaining the property might be liable for your injuries. If a business or establishment doesn’t clean up icy sidewalks, or leaves obstacles where you can trip over them, their negligence could make them liable. In addition, if employees or contract workers at a business cause hazards that result in slip and fall accidents, the owner of the property can be found liable in a premises liability suit.
The experienced premises liability attorneys at James R. Omer & Associates, PLLC, can help determine liability in this kind of case. With over a century of combined experience, we can plead your case and fight for compensation to help you settle your medical bills and recover from any injuries you might have sustained.
